Unless otherwise stated in a signed contract, all rights, title, and interest in and to all images remain the sole property of Rising Sun Photography LLC.
No image may be copied, downloaded, reproduced, republished, transmitted, stored, or used in any form—digital or print—without express written permission and a signed licensing agreement.
Unauthorized Use, Penalties, and Billing
Unauthorized use of any image owned by Rising Sun Photography LLC for commercial, business, marketing, or promotional purposes will result in a minimum penalty of $1,000 USD per image.
This fee represents a copyright infringement penalty for unauthorized use and does not constitute a retroactive license.
However, upon notification and payment of the $1,000 penalty, the infringing party may elect to legitimately license the image for continued use by purchasing a digital usage license for an additional $750 USD.
Failure to resolve unauthorized use within 14 business days of notification may result in a formal DMCA takedown request, and additional damages may be pursued under applicable copyright law.
Personal and Editorial Use
Limited use of images for non-commercial, editorial, or personal reference may be considered only with prior written approval.
